The court costs in Ontario are $466 including the $19 certificate (unless you qualify for the low-income waiver). And the affidavit evidence which is used so that you don’t have to attend the court is $150. The total for all fees, costs and taxes – start to finish - is $973.37.

A "simple" divorce is wherein you are asking for only the dissolution of the marriage itself, and not requesting a division of property, spousal support or any order relating to child(ren) at this time.

The court will grant your divorce after one year of separation has passed; however you may start your divorce proceeding (if you wish) anytime after you have separated.

You must have your spouse's co-operation, or failing that, at least his or her present address - so that we can serve him or her with the required documents.

What about the $195 Do-It-Yourself service offered?

We don’t recommend it and here’s why:

  • All it includes is the document preparation;
  • You have to make 3 to 4 trips down to the court office to file your documents (in a typical case)
  • You have to read complicated instructions and serve your spouse the documents

By the time you’ve taken three or four days off work – and waited in line-ups that can be in excess of 2 ½ hours and paid for downtown parking. And – you still have to pay the $466.00 in court costs. It’s just not worth it! (Unless you’re living in a small town way up in Northern Ontario and the alternative is paying the only lawyer in town $2,000.00 plus costs, in which case of course we will provide you with the do-it-yourself package if you wish.)
