TERMS AND CONDITIONS
By accessing this web site and/or using the services we offer it is acknowledged that you have read , understood and accept the following terms and conditions:
This website - The information contained in this website is of a general nature and intended for informational purposes only and does not constitute legal advice. Although every effort is made to provide accurate and up-to-date information, no representation or warranty is provided with respect to the accuracy of its content.
What we offer you - Toronto Divorce Services offers the service of preparing and filing the forms for your *simple, uncontested divorce for you if you don't feel you need or want actual legal representation; our services are entirely clerical (only) in nature.
For legal advice or any other legal service - it is recommended that you retain the actual legal representation of a lawyer as described below. Though, if you do decide not to consult with a lawyer before using our service you should at least review the Ontario Government publication entitled "What You Should Know about Family Law in Ontario"(available in nine languages) at:
www.attorneygeneral.jus.gov.on.ca/english/family/famlawbro.asp
Toronto Divorce Services offers the service of preparing and filing the forms for your *simple, uncontested divorce only. If your divorce becomes contested (by your spouse having asked the court not to grant the divorce or by making a claim to the court for any other kind of relief) then our services come to an end immediately and no portion of our fees will be refunded.
What we do not offer - Toronto Divorce Services is not a law firm or a lawyer, does not give legal advice of any kind regarding property/support/financial matters and/or regarding children – including whether or not you should obtain a divorce or obtain a divorce at this time; and nothing on this website and nor anything spoken over the telephone by Toronto Divorce Services' owner, operator or anyone else in the employ of Toronto Divorce Services should be construed as such. Moreover, where there is no prior separation agreement legally settling financial issues surrounding the divorce it is possible that valuable interests may be lost or limited by your divorce having been granted; Toronto Divorce Services will not be responsible for any damage or loss of any kind that may occur as a result of using this service or using this website, and/or of not consulting a lawyer beforehand, regarding financial or other issues effected by or surrounding divorce in general. It must be acknowledged that although reasonable precautions have been taken to ensure security in the transmission of information to and from this service, communications to and from the Website can not be guaranteed to be secure and that Toronto Divorce Services will not be responsible for any damages which may arise from such being intercepted. Our website, however, is set up with a secured transmission connection (for the transmission of credit card data directly) between you and your credit card payment processor.
Refund Policy - Because the overwhelming majority of the work involved in our particular procedure is done at the very beginning, the following policy applies: there is only a full refund should you change your mind with respect to hiring us to perform these services where no work, including document preparation, has yet been started. Where the first set of documents (the first of two sets) has been prepared only, should you change your mind at that point and we have received your notification in writing by e-mail (allowing 48 hours for us to receive and open your mail) and provided that the said documents have not yet been filed with the court, there will be a refund of $150.00 of our fees and any (unused) court fees you have paid in advance. After that point, where the divorce proceeding has been legally commenced in the court and the second set of documents have been prepared there will be no refund on our flat-rate fees.
All clients of Toronto Divorce Services are required to agree to the above as the terms and conditions of our providing this service to you.
ACTUAL LEGAL ADVICE AND REPRESENTATION OF A LAWYER - If you are looking for actual legal representation in regards to your divorce proceeding and/or issues surrounding it, that is to say whereby they will be acting on your legal behalf, giving you legal advice and/or generally tending to your legal interests – the old fashioned, traditional solicitor/client relationship - then we can not help you with that matter and only an Ontario lawyer is legally permitted to act for you.
